Article 1 – Definitions

In these Terms and Conditions, unless otherwise stated:

  1. “Human Pro” / “we” / “us” / “our”: Refers to Hyperflow B.V., trading under the brand name Human Pro Supplements, registered in the Netherlands.
  2. “Consumer” or “you”: The natural person who, not acting in the course of a profession or business, enters into a distance contract with Human Pro.
  3. “Entrepreneur”: Hyperflow B.V., trading as Human Pro Supplements.
  4. “Distance Contract”: A contract where, within the framework of a system organized by the Entrepreneur for distance selling of products and/or services, one or more means of distance communication is exclusively used until the conclusion of the contract.
  5. “Reflection Period”: The 14-day period within which the Consumer can exercise the right of withdrawal.
  6. “Right of Withdrawal”: The option for the Consumer to withdraw from the Distance Contract within the Reflection Period without giving any reason.
  7. “Day”: Calendar day.
  8. “Durable Data Carrier”: Any means that allows the Consumer or the Entrepreneur to store information addressed personally to them in a way that future consultation and unaltered reproduction of the stored information is possible.
  9. “Extended Transaction”: A Distance Contract concerning a series of products and/or services, for which the supply and/or purchase obligation is spread over time.
  10. “Technology for Distance Communication”: Means that can be used to conclude a contract without the Consumer and Entrepreneur being physically present in the same space at the same time.
  11. “Offer”: Any proposal or quotation made by Human Pro to the Consumer regarding products or services.

Article 3 – Applicability

  1. These Terms apply to every Offer made by Human Pro and to every Distance Contract concluded between Human Pro and the Consumer.
  2. Before the Distance Contract is concluded, the text of these Terms will be made available to the Consumer. If this is not reasonably possible, Human Pro will indicate how the Terms can be viewed electronically or otherwise, and that they will be sent free of charge at the Consumer’s request.
  3. If the Distance Contract is concluded electronically, and if this is reasonably possible, the text of these Terms will be provided to the Consumer in such a way that the Consumer can easily store it on a Durable Data Carrier.
  4. In addition to these Terms, specific product or service conditions may apply. In the event of a conflict between additional terms and these Terms, the provision most favorable to the Consumer shall prevail.
  5. By placing an order or otherwise entering into an agreement with Human Pro, the Consumer accepts these Terms without reservation.

Article 4 – The offer

  1. If an Offer has a limited period of validity or is subject to conditions, this will be explicitly stated.
  2. The Offer contains a complete and accurate description of the products and/or services offered. Images and descriptions aim to be truthful; any obvious errors or mistakes in the Offer do not bind Human Pro.
  3. The Offer includes clear information about:
    • The total price including taxes (e.g., VAT).
    • Any additional delivery costs.
    • How the contract will be concluded and which actions are required.
    • Whether the Right of Withdrawal applies.
    • The method of payment, delivery, and performance of the contract.
    • The validity period of the Offer or the price guarantee period.
    • Whether the contract will be filed after conclusion and how it can be consulted by the Consumer.
    • How the Consumer can check and correct any input errors before concluding the contract.
    • Any applicable codes of conduct and how they can be consulted electronically.
    • The minimum duration of any Extended Transaction.

Article 5 – The contract

  1. Subject to the provisions of paragraph 4 of this Article, the contract is concluded when the Consumer accepts the Offer and meets the applicable conditions.
  2. If the Consumer accepts the Offer electronically, Human Pro will confirm receipt of acceptance as soon as possible. As long as this confirmation has not been sent, the Consumer may withdraw from the contract.
  3. When a contract is concluded electronically, Human Pro will implement appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment. If the Consumer can pay electronically, Human Pro shall take suitable security measures.
  4. Human Pro reserves the right to, within the boundaries of the law, investigate whether the Consumer can meet their payment obligations, as well as all relevant facts and factors necessary for responsibly entering into a Distance Contract. If Human Pro has valid grounds to refuse an order or attach special conditions, it may do so, providing reasons to the Consumer.
  5. Human Pro will include, either in writing or in a manner accessible to the Consumer on a Durable Data Carrier, the following information upon delivery of the product or service:
    • The visiting address of Human Pro where the Consumer can lodge complaints.
    • The conditions under which and the manner in which the Consumer can exercise the Right of Withdrawal (or a clear statement if the Right of Withdrawal is excluded).
    • Information on warranties and after-sales services.
    • The information set out in Article 4(3) of these Terms, unless already provided prior to the conclusion of the contract.
    • The conditions for terminating the contract if it is of indefinite duration or has an Extended Transaction.
  6. In the case of an Extended Transaction, paragraph 5 of this Article applies only to the first delivery.

Article 6 – Right of withdrawal

  1. When purchasing products, the Consumer has the right to dissolve the contract without stating any reason within 14 days from the day the product is received by the Consumer or a third party previously designated by the Consumer.
  2. During the Reflection Period, the Consumer must handle the product and packaging with care. The Consumer shall only unpack or use the product to the extent necessary to decide whether to keep the product.
  3. If the Consumer exercises the Right of Withdrawal, they must return the product with all accessories and, if reasonably possible, in the original condition and packaging to Human Pro, following reasonable and clear instructions provided by Human Pro.
